Launched on the <a href="https://www.un.org/en/observances/parliamentarism-day">International Day of Parliamentarism</a>, the <a data-entity-type="file" data-entity-uuid="5688ff55-2715-468d-9cad-d94e968ab6de" href="https://globelegislators.org/sites/default/files/inline-files/GLOBE%20CVF%20Climate%20Laws%20Report%20-%20June%202022.pdf"><strong><em>Mapping Report on Climate Change Laws and Policies in Climate Vulnerable Forum (CVF) Countries</em></strong></a> reveals for the first time the extent of progress in creating legislative architecture and policy frameworks, to address climate change in 48 of the 55 member states of the Climate Vulnerable Forum.</p> <p>The report launch takes place during <a href="http://www.londonclimateactionweek.org/">London Climate Action Week</a>, the midway point as the UK COP26 Presidency hands over to Egypt’s Presidency of COP27 in November 2022. Emmanuel Marfo (Ghana), Speaker Mohamed Nasheed (Maldives), Congresswoman Loren Legarda (Philipines) and Saber Chowdhury MP (Bangladesh) – note:<br /> <br /> “<em>With all the focus on the executive branch, Parliaments and Parliamentarians are often ignored, sidelined or perhaps forgotten. We represent the people, make laws, and scrutinise and provide oversight over governments and the executive bureaucracy as they implement national policies</em>.”</p> <p><br /> They affirm that “<em>On climate, many Parliaments have been taking the lead, by framing and passing climate legislation which legally mandates governments to meet specific ambitious climate targets</em>.”</p> <p>However, they recognise that “<em>There is still insufficient legislative attention given to climate change in many countries, and we have to urgently change this situation if we are to push our governments to meet the goals set out in the Paris Agreement.</em>”<br /> <br /> Speaking on behalf of GLOBE International, chief executive, Malini Mehra, said:</p> <p>“<em>GLOBE is proud to have produced this first-ever Mapping Report to inform climate change efforts across CVF parliaments to improve scrutiny, enable benchmarking of progress and accelerate delivery. Importantly, it helps realise a key objective of the International Day of Parliamentarism: to promote public engagement and understanding.</em></p> <p><em>We hope the Mapping Report will facilitate peer to peer learning, identify gaps and promote best practice. For example, our initial analysis shows that 85% of CVF members have climate change laws, with more than ¾ having adopted or considering net zero targets. More than half seek to integrate mitigation, but links to adaptation and resilience are weaker. They also propose a practical roadmap for the parliament and the executive to start owning this innovative toolbox as nationally appropriate.</p> <p>Even ahead of their launches in <a href="https://gef6.globelegislators.org/democratic-republic-congo/article/kinshasa-181220-high-level-launch-redd-governance-assessment">Kinshasa</a>, <a href="https://gef6.globelegislators.org/nigeria/article/abuja-141021-flagship-readiness-reports-redd-great-green-wall-and-nca-launched">Abuja</a> and <a href="https://gef6.globelegislators.org/senegal/article/dakar-30-november-high-level-launch-project-research">Dakar</a>, their findings have been <a href="https://gef6.globelegislators.org/senegal/article/december-2021-globe-senegal-mps-drive-great-green-wall-and-redd-agenda-during">informing the work of legislators</a> and the executive in these countries to address the gaps identified, including technical capacity of National Statistical Offices, the mandate for the preparation of priority accounts, and the institutionalisation of the use of environmental economic accounting data for decision-making. In Senegal, the UN Statistics Division has responded to the demand for international expertise and is providing capacity support to the Senegalese Agency for Statistics and Demography. Following on from their <a href="http://www.globelegislators.org/news/item/bringing-the-2015-summits-home">'Bringing the 2015 Summits Home: A Guide for Legislators'</a>(2016), the Guide is designed to support the daily work of national legislators and parliamentarians to:</p> <p>(1) craft environmental laws that enable delivery of the post-2015 commitments and their vision of sustainable development,</p> <p>(2) guide, scrutinise and oversee decision-making by executive governments,</p> <p>(3) allocate resources for environmental assets and governance, and</p> <p>(4) build effective collaborations, contacts and capacity to deliver the post-2015 commitments.</p> <p>It asks a number of key questions:</p> <p>How are these important functions of parliaments being reshaped in the post-2015 era of sustainable development? How can legislators and parliamentarians do their part to ensure that the SDGs and other post-2015 commitments are achieved by 2030 and beyond? The year saw a succession of agenda-setting United Nations summits on disaster risk reduction (<strong>Sendai</strong>, March); finance for development (<strong>Addis Ababa</strong>, July); the post-2015 sustainable development goals (<strong>New York</strong>, September) and climate change (<strong>Paris</strong>, December). Their significance cannot be over-estimated and the importance of parliaments to their implementation cannot be under-estimated.</p> <p>As not all of these agreements are household names, awareness raising amongst legislators is the first task this paper sets itself. Explaining the background and key features of each major 2015 summit and process, it makes the case for a stronger role for legislators in ensuring that the outcomes of all these summits are implemented at a national level in an integrated and synergistic manner to ensure coherence and the desired impact.</p> <p>The paper offers guidance on the <strong>Top 10 Things Legislators Can Do</strong> to bring the 2015 Summits home, and illustrates action taken by legislators across the world to implement GLOBE’s Coherence &amp; Convergence approach to the 2015 summits. These efforts show that parliaments have a critical role in translating the multilateral frameworks agreed into meaningful national legislation that is locally owned, enjoys public trust and can be implemented.<br /> The paper holds that while implementation must be a collective effort engaging all stakeholders, it is the duty of parliaments to assure democratic accountability and oversight.</p> <p>Members of parliament should be at the heart of the Monitoring, Reporting and Verification (MRV) function demanded by this epic new generation of international agreements. the direction of travel is clear; and Encouragingly, it is developing countries and emerging markets, which are advancing climate change laws and regulation at the fastest pace.</li> <li>Even though the legislative progress is impressive, the cumulative ambition of these laws is not yet sufficient to limit global average temperature rise to 2 degrees Celsius above pre-industrial levels, the agreed goal of the international community.</li> <li>In order for a successful outcome in Paris in 2015 there is now extreme urgency to strengthen commitments, and for countries that have not yet passed climate change laws and/or regulations to do so.</li> </ul> <h3>Key Findings</h3> <p>In 2013 there was substantive legislative progress in 8 countries (passage of "flagship legislation") and positive advances in a further 19 countries.</p> <p>Key progress in 2013 includes:</p> <ul> <li><strong>Americas:</strong> <ul> <li>Bolivia passed its Framework Law on Mother Earth and Integral Development to Live Well;</li> <li>El Salvador adopted its National Climate Change Strategy;</li> <li>In Ecuador, Decree 1815 established the Intersectoral National Strategy for Climate Change;</li> <li>and in Costa Rica a draft General Law on Climate Change has been introduced and is expected to pass in 2014.</li> </ul> </li> <li><strong>Asia-Pacific:</strong> <ul> <li>China published its National Adaptation Plan;</li> <li>Indonesia extended its forest moratorium; The global stock of natural capital and valuable goods and services that it provides are being rapidly depleted, in some cases irreversibly. However the status of natural capital is not captured comprehensively by conventional wealth accounting frameworks such as the UN System of National Accounts, or by economic activity measures such as GDP. Therefore there is an urgent need to implement effective methods and measures for natural capital accounting and to embed these within relevant legal and policy frameworks.</p> <p><img alt="NC" data-entity-type="file" data-entity-uuid="40611ec6-9ec4-434e-ac59-3874f95aa6e1" src="/sites/default/files/inline-images/natural-capital-study-1.jpg" width="300px" class="align-right" /></p> <p>The 1st and the 2nd editions of the GLOBE Natural Capital Legislation Study were designed to inform efforts by legislators to address these needs. The 2nd edition of the Study, published in 2014, highlights <i>experiences developing legal and policy frameworks for natural capital accounting, challenges and lessons learned in <strong>twenty-one countries</strong></i> and outlines a vision for future action to improve the global knowledge-base concerning legal and policy options for managing natural capital. It was produced with the support of Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH on behalf the <a href="http://www.bmz.de/en/">German Federal Ministry for Economic Cooperation and Development (BMZ)</a>, and launched at the GLOBE Natural Capital Summit, held at the German Bundestag in 2013.</p> <img alt="CR" data-entity-type="file" data-entity-uuid="ab1ca7c1-62af-464d-b6b5-4b83670c7d58" src="/sites/default/files/inline-images/natural-capital-summit-floor-short-2.jpg" class="align-center" /> <p>This Study's <strong>three key conclusions</strong> are:</p> <ol> <li><strong>Efforts to develop laws and policies for natural capital accounting rely on continued cooperation and diverse forms of support.</strong> This entails <i>international effort</i> – accounting standards such as UN–SEEA; commitments and goals such as the post-2015 SDGs and Convention on Biological Diversity; capacity-building and research partnerships such as WAVES. It also entails <i>national efforts</i> – across various parts of government and diverse stakeholders, including communities and the private sector.</li> <li><strong>There is no ‘best practice’ approach to legal and policy reform for natural capital accounting.</strong> The task is complex and specific to national circumstances, cutting across many policies, institutions and sectors. Frameworks may involve combinations of new legislation, and new action under old laws. Practical national approaches that may prove useful for others are outlined.</li> <li><strong>A key future challenge for legislators is to develop and share innovative approaches for sustainably managing natural capital. </strong>Accounting is an important step towards that goal – others are needed. This Study highlights initial steps that countries have taken to link natural capital accounting with broader strategies for natural capital management</li> </ol> <h5>Resuls in the 1st Edition of the Study <a class="file file--mime-application-pdf file--application-pdf" data-entity-type="file" data-entity-uuid="f67044bc-fe76-46d0-9229-37bcde54c245" href="/sites/default/files/inline-files/GLOBE-Natural-Capital-Legislation-Study_0.pdf">(download here</a>) of 2013, covering eight countries, had shown that:</h5> <ul> <li><b>All eight countries are moving beyond thinking and experimentation towards the proper integration of natural capital into national accounting and policy making process.</b></li> <li>However <b>none of the countries is advancing comprehensively on all the necessary fronts</b> - wealth accounting, development of national ecosystem assessments, valuation of ecosystem services and institutional and legislative reform.</li> <li>The most comprehensive natural capital-specific legislation and policies are to be found in developed countries, although these are nonetheless failing to carry out a comprehensive overhaul of policies affecting natural capital, i.e. the unsuccessful 'structural greening' of the EU Common Agricultural Policy.</li> <li><b>Substantive progress is taking place in emerging economies</b>, which shows how natural capital accounting is increasingly understood as an indispensable instrument supporting decision-making towards sustainable and inclusive socioeconomic development.
